Affidavit of Support

The Affidavit of Support, or Form I-864, is a legal contract signed by a sponsor to demonstrate that they have sufficient financial resources to support the immigrant applying for permanent residency. Its purpose is to ensure that the immigrant will not depend on public benefits and will have financial support during their settlement process in the United States.

General Requirements

  • In order to complete and sign the I-864, the sponsor must:

  • Be a U.S. citizen or permanent resident.

  • Be 18 years of age or older.

  • Living in the United States (address).

  • Have an income equal to or greater than 125% of the federal poverty level corresponding to the size of your household.

  • Provide solid evidence of income or, in some cases, include a joint sponsor if you do not meet the required income.

Basic Documentation

The sponsor (and co-sponsor if applicable) must submit:

  • Copy of the most recent tax return (tax return or IRS transcript).

  • W-2 or 1099 forms from the last year.

  • Proof of current income (pay stubs, letter from employer).

  • Copy of the sponsor's passport, citizenship, or Green Card.

  • Evidence of assets if used to supplement income (bank accounts, properties, vehicles, etc.).

  • Form I-864 or I-864A, as applicable.

  • cease to be a resident, or

  • die.
